Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and 15751608 Canada Inc., operating as “BioMarker Coach” (“BioMarker Coach,” “we,” “us,” or “our”), governing your access to and use of the BioMarker Coach website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. At account creation, you are asked to affirmatively confirm — via a required checkbox — that you are 18 or older, in addition to agreeing to these Terms and our Privacy Policy.

2.2 Not medical care

The Service does not provide medical advice, diagnosis, or treatment, and does not create a doctor-patient, nutritionist-client, or any other clinical relationship between you and BioMarker Coach. See our Medical & Nutrition Disclaimer and AI-Generated Content Disclaimer below, both incorporated by reference. If you have a medical concern or emergency, contact a qualified healthcare provider or emergency services.

2.3 Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@thebiomarkercoach.com if you suspect unauthorized access.

2.4 Acceptable use

You agree not to: upload lab results or health information belonging to another person without their explicit authorization; use the Service unlawfully or in a way that infringes anyone else’s rights; attempt to access another user’s account or data, reverse-engineer the Service, or interfere with its normal operation; use automated means to access the Service outside of any API we may separately offer; or resell, sublicense, or otherwise commercially exploit the Service without our written permission.

2.5 Subscriptions and payment

If you purchase a paid plan, the Subscription, Cancellation and Refund Terms below govern billing, cancellation, and refunds, and are incorporated into these Terms by reference.

2.6 Intellectual property

The Service, including its underlying software, our proprietary nutrition knowledge base, and all content we provide, is owned by BioMarker Coach and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. You retain ownership of the lab data and questionnaire answers you upload.

2.7 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, INCLUDING ANY AI-GENERATED REPORT, WILL BE ERROR-FREE, UNINTERRUPTED, OR MEDICALLY ACCURATE.

2.8 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIOMARKER COACH AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

2.9 Indemnification

You agree to indemnify and hold BioMarker Coach harmless from any claims, damages, or expenses arising from your violation of these Terms, misuse of the Service, or violation of any third party’s rights.

2.10 Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.

2.11 Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If you are a consumer resident in a jurisdiction whose law does not permit this choice for consumer-protection purposes, the mandatory consumer-protection laws of your home jurisdiction will apply to that extent. You and BioMarker Coach agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, subject to the same carve-out.

2.12–2.13 Changes and contact

We may update these Terms from time to time; material changes will be communicated by email or in-app notice before they take effect. Questions: support@thebiomarkercoach.com.

Medical and Nutrition Disclaimer

BioMarker Coach is an educational and informational tool. It is not a substitute for professional medical or nutrition care, and using it does not create a doctor-patient or nutritionist-client relationship.

BioMarker Coach’s proprietary nutrition knowledge base was developed by BioMarker Coach’s founder, a nutritionist, based on her professional nutrition education and experience in nutrition practice. See our Methodology page for more detail on how the knowledge base and analysis were developed.

No diagnosis or treatment.BioMarker Coach does not diagnose any medical condition, prescribe medications, or provide medical treatment. Recommendations reflect patterns identified by comparing your lab values against standard laboratory reference ranges, evidence-informed optimal nutrition ranges, and BioMarker Coach’s proprietary nutrition knowledge base, developed from professional nutrition education, peer-reviewed scientific literature, established nutrition resources, and evidence-informed nutrition principles.
Supplement guidance.Where your report suggests a specific supplement, it may include a preferred form and dose sourced from BioMarker Coach’s proprietary nutrition knowledge base — never invented by the AI. This is still general educational information, not a personalized prescription. Always confirm any supplement, and its dose, with a healthcare provider before starting it.
Not a substitute for your doctor. Always consult a licensed physician or other qualified healthcare provider before making changes to medication or treatment.
Emergencies. If you believe you may have a medical emergency, call your local emergency number or go to the nearest emergency room immediately. Do not use BioMarker Coach for urgent concerns.
Nutrition guidance is general and does not account for every aspect of your health history, medications, allergies, or conditions that only a healthcare provider can assess.
Lab results have limits — a single blood test is a snapshot, affected by fasting status, hydration, time of day, medications, and lab methodology.
Pre-existing conditions, pregnancy, and medication use — talk to your healthcare provider before acting on anything in your report if any of these apply to you.
Adults only. This Service is written for and intended solely for use by adults 18 or older.

Required User Acknowledgment (Section 12.5): I acknowledge that BioMarker Coach provides educational and informational content only. I understand that its reports, recommendations, supplement information, meal plans, alerts, flags, prioritizations, and AI-generated responses are not medical advice, diagnosis, prescription, treatment, clinical assessment, medical triage, or a substitute for professional healthcare. I understand that the information may contain errors, omissions, inaccuracies, or limitations and that I should consult an appropriately qualified healthcare professional before acting on it. I understand that I must not use the Service to determine whether I need emergency, urgent, routine, or non-urgent medical care. Where the Service presents this acknowledgment as a separate checkbox, you must actively confirm it before uploading health information or initiating an analysis.

AI-Generated Content Disclaimer

Your BioMarker Coach report is generated using artificial intelligence (Anthropic’s Claude models), which analyzes the marker values extracted from your uploaded lab results and questionnaire answers against BioMarker Coach’s proprietary nutrition knowledge base.

AI can make mistakes — it can misinterpret data, produce inaccurate statements, or omit relevant information. We test and review the underlying logic but cannot guarantee every report is error-free.
Your report reflects patterns, not certainty— words like “possible” or “concern” mean a pattern worth discussing with a healthcare provider, not a diagnosis.
Extraction can be imperfect — always double-check the marker values shown in your report against your original lab document, and let us know at support@thebiomarkercoach.com if something looks wrong.
The knowledge base reflects BioMarker Coach’s nutritionist-developed methodology— developed by BioMarker Coach’s founder, a nutritionist, from professional nutrition education, peer-reviewed scientific literature, established nutrition resources, and evidence-informed nutrition principles, subject to ongoing review.
Not a substitute for clinical judgment — no AI system can replace a qualified healthcare provider who can examine you, take a full history, and order additional testing.

Marketing & Social Media Content

BioMarker Coach maintains social media accounts (Instagram, TikTok, YouTube, and Facebook) for educational content. The following practices apply to that content, separate from the Service itself.

AI-generated presenter.Some of our educational videos feature an AI-generated presenter avatar rather than a real person. These videos are for general education only and do not represent personal clinical experience or a real patient’s story unless explicitly stated.
Testimonials. Testimonials shared on our website or social media are collected with permission from real BioMarker Coach users and are anonymized unless the user has specifically agreed to be identified by first name. Individual experiences vary, and testimonials are not a guarantee of similar results.
Sample report walkthroughs.Some content demonstrating how the product works uses sample data for illustration only and is not an actual user’s lab results.
Advertising and creator partnerships.If we run paid advertising or work with content creators, we apply the disclosure labels required by each platform and by the FTC (such as “#ad” or “#sponsored”) whenever a post involves payment or free product in exchange for coverage.

Before you upload a blood test or complete the health questionnaire, we want you to understand — and actively agree to — how your health information will be used. By checking the consent box before uploading a lab report or submitting the questionnaire, you confirm that you understand and agree that:

We will collect and process your uploaded lab results and questionnaire answers to generate a personalized educational report for you.
Your information will be processed by Anthropic’s Claude API, a third-party AI service based in the United States.
Your health information will be transferred to and processed in the United States as part of this process, even if you are located in Canada.
The report you receive is educational, not medical advice.
Only the data you have uploaded belongs to you — you confirm any lab report you upload is your own, or that you are authorized to share it.
You may withdraw this consent at any time by deleting your account or emailing support@thebiomarkercoach.com.
You are 18 years of age or older.

You do not have to use BioMarker Coach. If you do not consent, simply do not check the box, upload a lab report, or complete the questionnaire. Because each new lab report or questionnaire submission involves a new transfer of health information for AI processing, we ask for this consent again — briefly — each time you upload a report.

Subscription, Cancellation and Refund Terms

6.1 Plans and pricing

Free Preview — a limited free sample of a report, at no cost.
Single Analysis — a one-time purchase (US$19.99) for 1 report credit.
Health Tracker — a one-time purchase (US$39.99) for 3 report credits.
Long-Term Tracker — a one-time purchase (US$59.99) for 5 report credits (best value).

Every package is a single, non-recurring purchase — none of them automatically renew. Report credits never expire. Prices are shown in USD (labelled “USD” or “US$” next to each price) and are exclusive of applicable taxes unless stated otherwise; your bank or card issuer may apply currency-conversion fees.

6.2 Two ways to purchase

On our website via Stripe, or inside the iOS/Android app via Apple’s or Google’s in-app purchase system — both unlock the same account.

6.3 Gift purchases

Any package may be purchased as a gift by providing the recipient’s email address at checkout instead of applying the credits to your own account. We generate a redeemable gift code and deliver it in connection with that email address; the recipient creates their own account to redeem it. As the purchaser, you will not receive the recipient’s health information, reports, or analysis results. Gift codes do not expire. If a code is lost or sent to the wrong address, contact support@thebiomarkercoach.com to have the original code deactivated and a replacement issued once we verify the original purchase.

6.4 Refunds

Website purchases: request a refund within 14 days of the charge by emailing support@thebiomarkercoach.com, provided none of the credits in that purchase have been redeemed or used — once any credit from a package is used (or a gift code from it is redeemed), the entire purchase is no longer refundable. App Store / Google Play purchases: refunds are requested from and decided by Apple or Google directly.

6.5 Chargebacks and fraud

A chargeback, payment dispute, or suspected fraudulent transaction results in immediate suspension of the associated account and freezing of the associated report credits, pending resolution.

6.6 Account deletion

Deleting your account forfeits any unused report credits on it — they are not refunded. An unredeemed gift code you purchased for someone else is unaffected by your own account’s deletion.

6.7 Price changes

We may change package prices or contents at any time; since every purchase is one-time, a price change only affects purchases made after it takes effect — it never changes what you already bought.

6.8 App Store / Google Play purchases

Billing and refunds for in-app purchases are handled entirely by Apple or Google — not by us. We do not receive or store your payment card details regardless of which path you purchase through.

Cookie Policy

7.2 What we currently use

Essential cookies: authentication/session cookies set by Supabase Auth, which keep you signed in.

Advertising cookies (marketing site only):we use Meta’s advertising pixel on our public marketing pages (never inside the app, and never on any page where you view or enter health information) to measure ad performance and retarget prior visitors. We do not send your health information to Meta under any circumstance.

7.4 Managing cookies

Because our marketing pages use an advertising cookie, a cookie preference banner is shown on first visit, offering three choices: Accept All, Reject Non-Essential, and Manage Preferences. Rejecting non-essential cookies disables the Meta pixel for your visit but does not affect the essential authentication cookie. Most browsers also let you view, delete, and block cookies through their own settings.

Account and Data-Deletion Policy

8.1 Soft-deleting your account

From your profile page, you can delete your account, which immediately deletes your saved reports, clears locally stored questionnaire answers and settings, and signs you out. This does not, by itself, delete your underlying login/authentication record.

8.2 Requesting full deletion

Email support@thebiomarkercoach.com from your registered email address with the subject line “Full account deletion.” We will verify your identity, complete full deletion (including from backups) within 45 days, and confirm once it’s done.

8.3–8.4 What we can’t undo, and data you export

Deleting your account does not un-generate reports already created, and does not automatically cancel an active paid subscription — cancel that separately first. You can download your reports as a PDF before deleting your account.
